Towarowa Giełda Energii S.A. (TGE) attaches particular importance to ensuring security of personal data.

This Privacy Policy contains detailed information concerning processing of personal data obtained through TGE’s websites, i.e.: www.tge.pl and air.tge.pl, specifies the legal basis for the processing, collection and use of personal data and provides information on the rights of the natural persons whose data are processed.

Definition of personal data

Personal data means information about an identified or identifiable natural person within the meaning of Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46 (GDPR). TGE processes personal data for various purposes; depending on the purpose, different collection methods, legal basis for processing and storage periods may apply.

TGE has implemented a number of measures to best protect your personal data against loss, destruction or damage, and in particular against unauthorised access. This involves both to technical security measures and organisational solutions.

Purpose of processing

TGE may acquire the following personal data through its website:

• Business contact data obtained through the contact via e-mail addresses indicated on the site;
• The data of the senders of the correspondence directed to TGE to the e-mail addresses indicated on the website;
• The data provided during telephone conversations to telephone numbers which are subject to recording – this includes dedicated telephone numbers for handling notifications, especially those related to the support of trading sessions;
• The data of the subscribers of “Kurier TGE” – exclusively for information purposes and to provide access to market knowledge;
• The data of the recipients of orders for the provision of information services obtained through the order form at www.air.pl.

Moreover, your personal data may be processed by TGE for the following purposes:

• execution and performance of contracts; 
• fulfilling the Controller's legal obligations (e.g. keeping records required by law, issuing VAT invoices, preparing tax statements, etc.);
• use and dissemination of your image to document an event/conference subject to your prior consent; 
• resulting from the legitimate interests of the Controller, e.g. organization of events, conferences, trainings. 

Basis for data processing

Where the processing of personal data is necessary for the performance of a contract to which the data subject is a party (for example, where the processing is necessary for the performance of a service) the processing takes place on the basis of the contract.

If the processing of data is necessary to fulfil a legal obligation, e.g. tax regulations resulting from the necessity to report on or document the performance of services, the processing takes place on the basis of such legal obligation.

In case of processing of personal data for other purposes specified above, the basis for processing is the legitimate interest of the Controller or the consent of the data subject.

Storage period

The personal data processed by TGE are stored for the period deemed necessary to fulfil the purpose for which they were collected (including as required by the applicable laws), and such period may be extended if the storage of the data proves necessary to assert or pursue claims related to the provision of services in respect of which the data are processed, or to defend against such claims.

Recipients of data

The access to your personal data may be given to:

• Controller’s employees and associates authorized to process your personal data;
• Entities from the Capital Group within the scope and subject to the principles set out in the relevant agreements, i.e: Warsaw Stock Exchange (Giełda Papierów Wartościowych w Warszawie S.A.), Warsaw Commodity Clearing House ( Izba Rozliczeniowa Giełd Towarowych S.A.)
• entities to whom the Controller has entrusted the processing of personal data, including: technical and organisational service providers (specifically the providers of IT services);
• auditors, chartered accountants and consulting companies may also be the recipients of the data;
• other entities, persons or bodies – to the extent and under the conditions stipulated by the provisions of law.

The sharing of your personal data with the above mentioned entities shall take place in accordance with the applicable legal regulations and in compliance with the principles for ensuring to their security and confidentiality.

Rights related to the processing of personal data

Every person whose personal data is processed by the Controller has the right to request access to, rectification, erasure, restriction of processing and the transfer of his or her personal data, subject to the conditions resulting from the relevant provisions of law, including Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data and, repealing Directive 95/46/EC (hereinafter “GDPR”).

Every person shall have the right to lodge a complaint with the President of the Personal Data Protection Office against the processing of their data, and in case when the a consent was the basis for the processing – to withdraw their consent at any time without affecting the lawfulness of processing carried out on the basis of the consent prior to its withdrawal.

Specifically, every person shall have the right to object to the processing of their personal data on the basis of the legitimate interest of the Controller, and to object to the processing of their personal data for the purposes of sending marketing information.

Cookies

Cookies are used to manage the site and improve navigation.

Cookies provide statistical data about the users' traffic and their use of particular pages of the TGE’s website. Each user has the option to disable cookies in their browser but this may affect some of the functionalities available on the websites. Other information

The website also collects anonymous data on the statistics of website visits using Google Analytics. The tool is based on cookies and does not provide personally identifiable information. 

The service also processes data transmitted during electronic communication: IP numbers assigned to computers and other devices in ICT networks, registered in logs of the TGE's IT systems, including in connection with website visits in the TGE’s domain; these data are processed in order to ensure appropriate functionality and security of the IT systems of TGE.

The website may contain links to third party websites. TGE is not responsible for the privacy policies applied by the owners of any sites linked to from its website.
